Welcome to wave-travelers.com. These Terms and Conditions (“Terms”) govern your use of our website and travel booking services. By accessing or using our services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our services.
1. SERVICE DESCRIPTION
1.1 wave-travelers.com is an online travel agency that acts as an intermediary between travelers (“you,” “the Customer”) and travel service providers, including airlines, hotels, and other related services.
1.2 We do not operate flights, hotels, or other travel services. We act exclusively as booking agents on behalf of the service providers.
1.3 By making a booking through our website, you acknowledge and agree that:
The contract of carriage is established directly between you and the airline.
The accommodation contract is established directly between you and the hotel.
We are solely the agent facilitating the booking.
2. BOOKINGS AND PAYMENTS
2.1 Booking Processing: All bookings are subject to availability and confirmation by the service provider. We do not guarantee the availability of any service until we receive official confirmation from the provider.
2.2 Pricing: Prices shown on our website are subject to change without notice until the booking is completed and confirmation is received. We strive to display accurate prices, but typographical or technical errors may occur.
2.3 Fees and Charges: In addition to the base price, we may charge: an Agency Booking Fee, fees for optional services (seats, baggage, premium support), and applicable taxes.
2.4 Payments: We accept credit/debit cards and electronic payment methods. All payments are processed securely through our authorized payment providers (Duffel Payments, Stripe, etc.).
2.5 Identity Verification: We reserve the right to request additional documentation to verify your identity and prevent fraudulent activity.
3. CANCELLATION AND REFUND POLICY
3.1 General Policy: Cancellation and refund policies vary according to the service provider and the type of fare purchased. We recommend carefully reviewing the policies before completing your booking.
3.2 Refund Processing: Refunds are processed in accordance with the service provider’s policies. Please note that:
Refunds are subject to the airline’s policies and their respective processing time.
Refunds may take between 30 and 90 days to process.
We do not advance refunds with our own funds; the return is contingent upon our actual receipt of the funds from the provider.
The refund will be issued to the original payment method used for the purchase.
3.3 Refund Processing Fee: For each refund request processed on your behalf, we will apply a $35.00 USD administrative fee to cover associated processing costs.
3.4 Non-Refundable Tickets: In the case of non-refundable fares, we will be unable to process refunds, but we may assist you in requesting travel credits or vouchers according to the airline’s policies (subject to additional service fees).
4. CHANGES AND MODIFICATIONS
4.1 Requests: If you wish to make changes to your booking, we will contact the service provider on your behalf.
4.2 Availability and Costs: Changes are subject to availability and the provider’s policies. You will be subject to any airline-imposed change fees plus our $35.00 USD change management fee.
4.3 Fare Differences: You are responsible for paying the fare difference if the new service is more expensive. If the price is lower, the service provider will determine if a partial refund is issued and under what conditions.
5. RESPONSIBILITIES AND LIMITATIONS
5.1 Our Responsibility: Our responsibility is strictly limited to providing travel agency services. We are not responsible for: cancellations, delays, or changes made by airlines or providers; loss, damage, or delay of baggage; security, health, or destination conditions; or acts of God, weather conditions, strikes, civil unrest, or any other cause beyond our reasonable control.
5.2 Limitation of Liability: To the maximum extent permitted by applicable law, our total liability for any claim arising from our services shall not exceed the total amount paid by you for the service in question.
5.3 Indirect Damages: In no event shall we be liable for indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, business opportunities, or anticipated savings.
6. CUSTOMER OBLIGATIONS
6.1 Accurate Information: You are responsible for providing accurate and complete information, including full names as they appear on your passport, birth dates, and contact information.
6.2 Travel Documentation: You are responsible for ensuring you possess all necessary documentation, including a valid passport (with at least 6 months validity), required visas, vaccination certificates, and any other documentation required by authorities.
6.3 Booking Errors: If errors are detected after issuance (incorrect names, dates, etc.), you may be subject to fees imposed by the airlines (Agent Debit Memos – ADMs). You are responsible for paying any additional charges incurred due to errors in the information provided.
6.4 Proper Use: You agree not to use our services for fraudulent or illegal activities, to make speculative bookings, or to violate the rights of third parties.
7. FRAUD PROTECTION
7.1 We reserve the right to withhold any booking and request additional documentation if we detect suspicious activity.
7.2 If we determine, at our sole discretion, that a booking was made fraudulently, we reserve the right to cancel it immediately without refund.
8. ADDITIONAL AND OPTIONAL SERVICES
8.1 Premium Support: Our Premium Support service ($19.99 USD) offers priority assistance. This service does not guarantee the receipt of refunds or compensation but provides dedicated assistance in managing these situations on your behalf.
8.2 Travel Insurance: Insurance is provided through third-party providers and is governed by their specific terms and conditions, not ours.
9. INTELLECTUAL PROPERTY
9.1 All content on our website is the property of wave-travelers.com and is protected by intellectual property laws.
10. THIRD-PARTY LINKS
10.1 Our website may contain links to third-party websites. We have no control over their content and assume no responsibility for any loss or damage arising from their use.
11. MODIFICATION OF TERMS
11.1 We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of our services constitutes your acceptance of such changes.
12. GOVERNING LAW AND JURISDICTION
12.1 These Terms shall be governed by and construed in accordance with the laws of Ontario, Canada, without regard to its conflict of law principles.
12.2 Any dispute shall be subject to the exclusive jurisdiction of the courts of Ontario, Canada.
13. MISCELLANEOUS
13.1 Entire Agreement: These Terms constitute the entire agreement between you and us.
13.2 Severability: If any provision is deemed invalid, the remaining provisions shall continue in full force and effect.
13.3 Waiver: Our failure to enforce any right or provision shall not constitute a waiver of such right.
