Welcome to wave-travelers.com. These Terms and Conditions (“Terms”) govern your use of our website and travel booking services. By accessing or using our platform, you agree to be legally bound by these Terms. If you do not agree with any part of them, you must not use our platform.

1. ROLE AS AN INTERMEDIARY

Wave Travelers operates exclusively as an independent travel agency and technology booking platform. We do not own, operate, or control any airlines, hotels, or third-party travel providers (“Travel Suppliers”). When you make a booking through us, the contract for travel services is established directly between you and the respective Travel Supplier. We act solely as a technological intermediary facilitating the transaction through our API integrations with providers such as Duffel (for flights) and Nuitee / LiteAPI (for hotels).

2. BOOKINGS AND CANCELLATION POLICIES

*US DOT 24-Hour Cancellation Rule: In compliance with U.S. Department of Transportation regulations, any flight booking to, from, or within the United States may be canceled within 24 hours of purchase for a 100% full refund, provided the booking was made at least 7 days (168 hours) prior to the scheduled departure.

*Standard Airline Rules: Once the 24-hour window has passed, all flight cancellations, changes, and refunds are strictly governed by the issuing airline’s fare rules. Wave Travelers has no control over these rules. Fares, non-refundable tickets, and airline credits are determined solely by the operating airline.

*Ancillaries: Fees for baggage, seat selection, and other extras are non-refundable according to the airline’s rules.

*Variable Policies: Hotel cancellation policies vary depending on the property and the specific rate plan selected at the time of booking. It is your responsibility to review the specific cancellation policy clearly displayed during the checkout process.

*Non-Refundable Rates: Many discounted rates offered through our API are strictly non-refundable from the moment of purchase.

*Late Cancellations & No-Shows: If you cancel outside the free cancellation window permitted for your specific rate, or if you fail to show up (“No-Show”), the booking will be considered 100% non-refundable. Wave Travelers is not obligated to issue refunds in these instances, as funds are settled with the hotel provider according to their own terms.

3. PAYMENTS & FEES

All prices displayed on Wave Travelers are in US Dollars (USD), unless otherwise stated. Full payment is required at the time of booking. You authorize Wave Travelers and its third-party payment processors to charge your payment method for the total amount of your reservation. We are not responsible for errors, duplicate charges, or transaction failures caused by external payment gateways or issuing banks.

4. TRAVEL DOCUMENTATION & COMPLIANCE

You are solely responsible for ensuring that you possess all valid travel documents required, including passports, visas, health credentials, and compliance with all entry requirements for your destination, transit, and origin countries. Wave Travelers is not responsible for any denial of boarding, denial of entry, or any consequences (including additional costs) arising from inadequate documentation.

You agree to indemnify, defend, and hold harmless Wave Travelers, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of or in any way connected with: (a) your use of the platform; (b) your breach of these Terms; or (c) your violation of any law or the rights of a third party.

7. DISPUTE RESOLUTION AND GOVERNING LAW

Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles.

Binding Arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms or your use of Wave Travelers shall be resolved exclusively through final and binding arbitration administered by the American Arbitration Association (AAA) or JAMS, in accordance with its Commercial Arbitration Rules. The arbitration shall take place in New Castle County, Delaware.

Class Action Waiver: You agree that any dispute will be resolved solely in your individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding. You expressly waive your right to participate in a class action lawsuit.

8. MODIFICATIONS TO TERMS

We reserve the right to modify these Terms at any time. Any changes will be posted on this page with a revised “Last updated” date. Your continued use of our platform after such changes constitutes your full acceptance of the revised Terms.
